My attorney want's to file my I-485 now to have a receipt that it is filed and sent back by USCIS. This shows up that I was capable of filing in July but I could not because USCIS did not accept on the last minute.
The Idea behind is that it will give advantage to my application if AILF wins the case.
Please let me know is this a good thing to do at this stage.

Hi,
I am travelling to India in November 2009. My visa recently expired and I got my H1b extension until 2012. I work for a big US company of repute. Although my company has no TARP related benefits from the GOV, given the economic conditions, I am little concerned if Stamping in India for visa could be a problem? My concern is if they would deny or delay the visa approval? I have all my documents valid including employment status.My GC is under process(I-140 approved).
Additionally, what precaution should I take that enhances my chances of successful visa stamping?
Please advise.

I was working for company A in US till June 2008. I had to return to India in July 2008 due to personal reasons. My 6th yr on H1b expired in October 2008.
I am now in India and applying for 3yrs H1b extension based on my approved I140 with company B. My I485 was filed in august 2007. I do not have US pay stubs since July 2008 as I did not work in US.
Has anybody been in a similar situation? What are the chances of getting approval? Once I get I797 approval, should I expect further challenges in getting visa stamped in India?

Hi, I was in India when my husband applied for my H1B in 2008. I got it picked in lottery and got the approval too. I came to US on H4. After Oct 1st 2008, we applied for Change of Status to H4 to legally complete the work permit process. In the Change of Status applicatin form, my company accidently did a mistake of mentioning that Current status=H1B, New status required=H1B. :mad: USICIS, on seeing the application, took a decision to give me H4 with new I-94. I tried calling the USCIS helpdesk, but in vain. :confused:
1) Now what should I do to start working in H1B?
2) Was I correct in ging throughChange of Status? Or could I start working with the approval copy I had?
3) Could I apply for SSN with the 2008 approval copy?
Any answers would be greatly apprrciated!. Thanks in advance........

Go ahead. By the time labor and I-140 gets approved, it could be close to two years based on current processing rate. At that time you will have a much better picture and can decide whether to file the I-485 or not. If the employer is willing to sponsor, why not?

Hi Forum,
My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.
It would be great if you guys let me know what is the process of converting this without going back to home country.
