My wife who is a derivative applicant for the GC is employed on EAD. She has been advised to go on a pregnancy short term disability leave by the doctor. We live in California and her company provides the short term disability through the California SDI.
Is it ok to claim this while having applied for GC. Is the SDI by any chance considered a public charge? Any help would be appreciated.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

I know this is forum is not the correct place to discuss this topic. But I am posting this because some members of the forum must have already faced ths issue.
I ahve a one month old newborn. We are planning to go to India for vacation end of July. I have to apply for my baby's US passport. But she has not received her SSN. The instuction says that SSN is not mandatory but IRS can fine you if you dont disclose that information. I tries to contact SSN office, IRS office and Passport Office. Each one will point to the other Agency. So not sure what what to do. Anyone who was in the same boat, please let me know whether there are any issues with applying for passport without SSN number.

What is the best way to save one from going out of status on E-3 visa?Can a E-3 Visa holder or E-3D visa holder may apply and successfully get EB-3 or EB-2 green card?Can E-3 visa holder may work for two employers (already USCIS approved extension petition from both) simultaneously (without filling any new I-129 or extension request)?
The place of birth for E-3 Visa holder is Pakistan.
Please suggest and advise?

My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.
My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
PLEASE HELP!!!

I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

My friend currently is in his home country. He worked with H1-b before, and left US because of being laid off (could not found a new job in time). His question is if he can apply for B2 and go to the US first, then stay in US looking for a job. After getting an offer, transfer his previous H1-b to a new company. Can he do like that? Thanks!

Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.
Have the following 2 cases filed for the same person.
PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved
If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?
